TSA-Approved or Not: Are CBD Gummies Safe to Take on Flights?

As CBD products have grown in popularity thanks to their health benefits (not approved by FDA), more people have started to travel with it. But, there is reason to be cautious.

Because of its associations with marijuana, CBD edibles consumers need to be especially careful. In fact, there have been instances where the presence of too much CBD has resulted in airport incidents and arrests. At the same time, it can be confusing to keep up with changing TSA regulations trying to determine if CBD gummies are legal.

Does that mean you can bring products like CBD gummies on a plane? Read on for an answer to that question and more.

Why Travel With CBD?

People fly with CBD because:

  • They’re regular CBD consumers and need to maintain their routine
  • They can’t get their preferred CBD brand nationwide while traveling
  • Recovering from stiff muscles and joints from travel or exercise

There are many benefits and uses of CBD edibles and gummies that can help travelers on a long plane ride. While travelers can find relief in CBD products, they should take into consideration what the legal standing of products like CBD gummies are in the places they are traveling from and to.

CBD gummies, or also known as CBD edibles, most recently had their biggest legal breakthrough with the 2018 Farm Bill. The bill took CBD off the list of Schedule I narcotics and allowed hemp to be legally grown in the United States. Yet, the biggest hurdle right now comes from the Food and Drug Administration (FDA) clearing CBD as a “generally safe” product. 

Statewise, even though the Farm Bill allows the production of hemp products that may contain up to .03 percent THC (the chemical responsible for a high), it could be limited even more or banned altogether.

Thus, CBD is federally legal in the US as long as it’s grown under the specifications listed in the 2018 Farm Bill, contains no more than .03 percent THC, and isn’t sold or marketed as a dietary supplement, food, or drink additive.

What Does the TSA Say About CBD?

On their website, the TSA states in regard to CBD-related products that “certain cannabis-infused products, including some Cannabidiol (CBD) oil, remain illegal under federal law except for products that contain no more than 0.3 percent THC.”

In other words, you are technically allowed to bring CBD products in your luggage or carry-on with you on the plane that:

  • Contain less than 0.3 percent of THC
  • CBD products made from mostly hemp
  • Approved CBD drugs like Epidiolex

Ultimately, it is up to the individual TSA officer to decide if items containing CBD can go through the security checkpoint.

Bringing CBD Edibles On International Flights

More carefulness should be taken when considering bringing CBD edibles internationally. This is because international regulations can be more unclear about the subject than in the US and some countries could have even stricter laws when it comes to CBD products.

Do your research on the laws of the country you are traveling to for their viewpoint on CBD edibles or other products. It is probably best to err on the side of caution and leave your CBD gummies at home.

How To Travel With CBD Edibles

When traveling with CBD edibles, it is best to follow the TSA’s 3-1-1 rule. You may know this as the rule you need to travel with liquid items on a flight. This means you should fly with no more than three ounces that fit in one quart-size bag in your carry-on bag. 

Also, look up online or print out the lab results or certificate of analysis (CoA) of the brand you are getting your CBD gummies/CBD edibles from. If doing all of the above seems too stressful for you and you do not want to risk a search, shop online or at a physical store before the trip and then ship the CBD product to the destination you are traveling to.

Take CBD Gummies On Your Next Flight

Because of its relaxing effects, it is understandable that people will want to take a certain amount of CBD products like CBD edibles with them on their flight. If you plan to do so, do research on how much can be legally brought onto the plane when flying domestically or internationally.
